 Booking Terms & Conditions

The terms and conditions set forth in this agreement (also referred to as “Terms”) constitute the entire understanding and agreement between you the tour participant (“Participant”) and Rothschild Safaris, Inc., a Colorado corporation, (“Rothschild Safaris,” “we,” or “us”) with respect to any and all bookings, reservations, tours or transactions made with Rothschild Safaris (“Tour” or “Tours”).

By booking a tour with us, paying a deposit or signing this agreement, you accept all of the terms in this agreement on your own behalf and on behalf of all persons listed on the booking, including any minor under your custody, care or control (“Minor” or “Child”) (also referred to individually as, “Traveler,” and collectively, “Travelers”), and direct us to perform services for each and every Traveler.


A booking is not accepted, and there is no contract for services between us, until the required deposit is paid and you receive written confirmation from us. We reserve the right to treat any reservation that is not fully paid according to the reservation and payment terms as a cancellation and subject to the cancellation terms below.


You and those traveling with you assume sole responsibility to independently confirm all documentation requirements for all passports, visas, vaccinations, immunizations and other entry and/or travel requirements of each of your destinations (collectively, the “Travel Requirements”). You assume sole responsibility for, and hereby release Rothschild Safaris from, any and all damages incurred as a result of your failure to comply with all applicable Travel Requirements. All passports must contain at least five consecutive blank pages and must be valid for at least six months after the completion of the tour. If you are visiting multiple countries on your tour, you may be required to have more than 5 consecutive blank pages. If you have questions about the number of consecutive pages required for your tour, you can contact Rothschild Safaris. Non-U.S. citizens should contact the appropriate consular office for entry requirements pertaining to their trip, as we are not responsible for providing you with this information or documentation. If one parent or guardian plans to bring a minor child without the other parent or parents,some nations have strict documentation requirements. Birth certificates may be required for children 18 years and younger. 

Some nations require proof of vaccination for all travelers. Any required inoculations must be recorded by the traveler’s health practitioner on a valid vaccination certificate, which the traveler must carry in his/her possession throughout the tour. You are also solely responsible for any adverse consequences, including additional costs and fees, resulting from incomplete or defective documentation. Passport and visa requirements may change at any point in time. It is the responsibility of each traveler to acquire the most up to date travel documents. Rothschild Safaris does not represent that the list is exhaustive or current. It is the sole responsibility of each traveler to obtain the necessary documentation for all aspects of their tour.

Responsibilities: Rothschild Safaris uses the service of agents, affiliates and/or third-party suppliers for various services provided for or associated with your Tour, including but not limited to lodging, meals, transportation, sightseeing, and activities connected to your Tour (“Supplier” or Suppliers”). While we use our best efforts to select the Suppliers for these components of your Tour, you acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, are not managed or controlled by us, and are not our agents or employees. A Supplier’s services are subject to the Supplier’s own terms and conditions, and the local laws and regulations of the relevant country. We will not provide any refund for a Supplier’s delay cancellation, overbooking, or strike. You acknowledge and agree that Rothschild Safaris is not responsible for and cannot be held liable for any negligent or willful act or failure to act of any Supplier, or of any other person or entity.

Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage, and you will be bound by these as far as the relevant common carrier or supplier is concerned. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other supplier, and they are often also subject to various international conventions. 


Airline tickets are normally highly restrictive, non-refundable and non-transferrable and are normally issued prior to your departure date. You are responsible for any increases in transportation fares, including airfares, up until the time the tickets are issued and for all cancellation, transfer and modification charges and change fees. Neither Rothschild Safaris nor its suppliers have control over airline or other transportation company operations. Thus, in addition to other limitations of liability set forth in these Terms and Conditions and other agreements between us that govern your Tour, you agree that Rothschild Safaris is not responsible or otherwise liable for any damages arising from or related to any airline timetable/schedule changes, delays, cancellations, missed connections, mechanical problems, inclement weather, seating reassignments, lost/delayed/stolen/damaged baggage, screening and security delays, refused boarding or failures to properly check-in.


Rothschild Safaris is not responsible or otherwise liable for the cleanliness of rest rooms, delays in immigration and customs, safety issues, for circumstances, situations and conditions when traveling to other countries or on safaris or for other “first, second or third world country happenings.” Rothschild Safaris is not responsible for travel restrictions that are placed on travelers going to or coming from any country. Any additional costs associated with travel, regardless of the reason, circumstance, world events, pandemics or otherwise, will be at the expense of the traveler. 


Rothschild Safaris or its independent suppliers may find it necessary to make last minute changes to the accommodations due to local conditions which are beyond its/their control. Rothschild Safaris makes no guarantee about the suitability or availability of accommodations and if particular accommodations sought are unavailable, Rothschild Safaris will do its best to reserve comparable accommodations, if possible. Normally changes are of equal or superior quality. If a substitution of equal or superior quality cannot be arranged, you will receive a refund for the difference in cost, if any. No charge will be made for upgraded accommodations.


Unless otherwise noted, tour prices quoted in our brochure, website and in all our proposals are per person, based on two people sharing a double room. Tour prices include Rothchild Safaris’ planning, handling and operational charges in addition to supplier costs and fees (typically non-refundable), are quoted in U.S. dollars and, subject to these Terms and Conditions, are based on the current in-house rate of exchange and tariff. Tour prices include accommodations, meals as specified, transfers, sightseeing as specified, hotel taxes, entrance fees to included features as specified, park fees, professional English-speaking guides for transfers and all tours as specified in the itinerary. Tour prices do not include international airfares and internal airfares unless otherwise specified in the itinerary; cost of passports or visas; items of personal nature such as beverages; laundry unless otherwise stated; phone calls; excess baggage; medical fees incurred; gratuities; airport departure taxes; sightseeing; game drives or meals not included in the itinerary; or travel insurance. Rothschild Safaris is not responsible for any errors or omissions in any quotes or advertisements, including information posted on its website, which occur as a result of its reliance on incorrect information supplied by third parties.

Prices and availability are not guaranteed and may change without notice, until your deposit/payment has been received by Rothschild Safaris and your booking has been confirmed by us in writing. If your deposit/payment is not received by Rothschild Safaris, on or before the Deposit Due Date, reservations will be automatically cancelled. In the event of a marked increase or decrease in foreign exchange or tariff rates, taxes, fees or surcharges, as Rothschild Safaris shall determine, costs are subject to revision.


A non-refundable deposit of twenty five percent (25%) of the land price per person is required at the time you book (“Deposit Due Date”). The remainder of the cost of your tour is due 90 days prior to your departure date. If your reservation is made 90 days or less prior to your departure date, the entire cost of your tour must be paid at the time of confirmation. Failure to remit payments on a timely basis will automatically subject your booking to cancellation.

If your tour includes the procurement of any specialty permits such as gorilla, monkey, chimp, climbing or any other permit not disclosed in these terms and conditions, you acknowledge that different payment and cancellation terms may exist.

Payments for Galápagos cruises: Final payments on select ships are due 90 days prior to your departure date. Also, payment schedules and advance deposit requirements may change for holiday departures due to high demand.

Payments can be made by check, credit card or wire. For security reasons, we will only provide payment information via encrypted email. Should you have any doubt regarding the veracity of payment instructions received you must call our office before making payment to verify payment details. Rothschild Safaris will not be held financially responsible for payments that are sent to fraudulent accounts.


If you are not happy with our services for any reason, you agree not to file a chargeback with your credit or debit card before you have given us an opportunity to address the matter. Your satisfaction is very important to us and we strive to stand behind our products and services. We will work to address any issue that you might have. By signing this agreement or booking a trip with us, you agree that chargebacks are not an appropriate way to avoid our cancellation and refund policy. We will vigorously dispute inappropriate chargeback requests and provide this agreement as proof that you agreed to our cancellation and refund terms. You may also be liable for reimbursement of our attorney’s fees, time, costs and expenses in rebutting the chargeback and pay any damages we suffer as a result of your chargeback.


Your cancellation of your booking must be made in writing to Rothschild Safaris. Cancellations are only effective when we receive your written notification of cancellation. There is no refund for any unused services should you leave your tour early for any reason. (This section applies to your cancellation of a Tour. Note that if we make changes to your Tour, up to and including cancellation, different terms apply, as outlined below.)

Our cancellation and refund policy takes into account the fact that we must advance to our suppliers deposits for their services, which are often non-refundable.

If a flight or other delay for any reason prevents you from joining the tour during any point of the tour, it will be considered a “no show” and no refund will be remitted to you. If you cancel your booking, you will forfeit the following:

The per person cancellation on the land costs are as follows:

  • 90+ days prior to departure 25% non-refundable deposit is forfeited
  • 89 – 60 days prior to departure 50% of tour price is forfeited
  • 59 – 31 days prior to departure 75% of tour price is forfeited
  • Within 30 days prior to departure 100% of the tour price is forfeited

*Figures are expressed as percentages of the total tour cost.

NOTE: Groups have a different cancellation policy. A group is defined as a reservation for greater than 40% of the total rooms available at any specific camp, per night.

NOTE: Galápagos cruises may have different cancellation and payment policies depending on the specific ship used.


Cancellation and transfer schedules for some tours are more strict. Further, any non-refundable deposits made to third-party suppliers and third-party cancellation fees will be subtracted from any refunds due under this section.

No refunds will be provided for any unused portion of a tour once the tour begins, including if you leave a tour for any reason, miss the tour’s departure date, or have to be removed from a tour. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, airline default, strikes, personal, family or medical emergencies, your decision to not go on a Tour because of governmental/travel warnings or advisories, including but not limited U.S. State Department or World Health Organization warnings, or any other circumstances beyond our control. For this reason, we strongly suggest that you secure comprehensive trip cancellation and interruption insurance in order to participate on a Tour. We also highly recommend that you consider securing “cancel for any reason” travel insurance, which must be obtained soon after your first deposit is paid for your travels.


If you request to make changes to your confirmed itinerary after we confirm your booking, we will do our best (but cannot guarantee we will be able to meet such requests) to accommodate your request. If we are able to make such changes, an administration fee of $40 per person will be payable together with any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers. Substantial change requests by you such as a change of tour dates will normally be treated as a cancellation of the original booking and rebooking in which case cancellation charges will apply. This change will result in recalculation of your original tour price. Change requests must be made in writing.


Rothschild Safaris reserves the right to cancel, alter, modify, postpone or reschedule any tour without prior notice for the safety and/or comfort of clients and for circumstances of Force Majeure (see information below). Rothschild Safaris shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder as a result of any actions that it takes or does not take under this section and under this Agreement.

You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.

Any changes that we make may require a supplemental payment from you. We will advise you in the event such a payment is required.

Regarding civil unrest, once Rothschild Safaris has investigated the prevailing situation as it deems fit, it shall remain in the sole discretion of Rothschild Safaris whether to proceed with the Tour. If Rothschild Safaris is of the reasonable opinion that the Tour may proceed, no refund will be payable to you and the cancellation provisions of this agreement shall apply.

No refunds will be provided if we cancel, alter, modify, postpone, or reschedule any Tour for any reason, whether before or during your Tour. We may, in our discretion without any requirement that we do so, use reasonable endeavors to reimburse you of any payments that you have made reduced by any and all non-refundable deposits and cancellation fees that we have paid to suppliers and other third parties to provide components of your Tour. Our administration costs in planning your Tour are not refundable because of the work involved in planning, booking and management of your Tour itinerary from the moment the Tour is booked. This fee is 10% of the Tour cost (“Administration Fee”), and one that we cannot recuperate, again because the time and materials already invested in the trip.

Additional Information regarding Force Majeure

In the uncommon situation where Force Majeure prevents, significantly hinders, renders it difficult, or makes it impossible for us or our Suppliers to provide the Services including but not limited to your Tour, we and/or our Suppliers shall be entitled to, in our sole and absolute discretion, take one or more of the following steps: vary, reschedule, postpone, cancel any Tour itinerary or arrangement, including Tour dates and the entire Tour itself. We regret that no refunds will be provided if we take any of the preceding actions due to Force Majeure, unless and to the extent we are able to obtain any refunds from our Suppliers. Any refund under this section will less our 10% Administration Fee. This policy is based on the fact that Suppliers, who are often located outside the United States, are not obligated to return non-refundable deposits or waive their cancellation fees in the case of Force Majeure. Further, it is not assured that we would easily be able to receive any refunds from our Suppliers once we have forwarded your deposits to them. Nor will we be able to pay you any compensation, costs or expenses you incur as a result. If you choose to cancel your Tour, our standard cancellation terms that govern when a traveler cancels apply. See above section titled “CANCELLATIONS BY YOU & REFUNDS.” 

If Rothschild Safaris is affected by Force Majeure, Rothschild Safaris, if practicable, will notify you of the nature and extent thereof.

Rothschild Safaris will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/COVID-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.


You agree that the sole remedy for any default by Rothschild Safaris arising under this Agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, Rothschild Safaris shall not be liable for any special, consequential, indirect, incidental or other damages arising out of this Agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Rothschild Safari’s has been advised of the possibility of such damages. You expressly waive any right it may have to recover such damages.


During your Tour, optional activities may be offered and furnished by other independent suppliers who are not affiliated with Rothschild Safaris in any way. Some of these optional activities carry with them various risks, including but not limited to attack by wild or domesticated animals, equipment/mechanical problems, and unexpected weather conditions, which can cause serious personal/bodily injury. Some of these activities include, but are not limited to: (1) horseback safaris; (2) walking safaris; (3) canoe trips; (4) camel safaris; (5) gorilla and chimpanzee trekking; (6) hot air balloon trips; (7) Masai village; (8) fishing excursions; (9) elephant back safaris; (10) bungee jumping; (11) white water rafting; (12) mokoro excursions; (13) snorkeling; (14) scuba diving (15) vehicle safari. Please be aware that although precautions may be taken by the suppliers to guard against such dangers, your safety cannot be guaranteed. Please also be aware that you are free to participate in such activities while you are on your tour and that these tours are not mandatory. However, you must understand that such participation will be at your own risk, and that Rothschild Safaris assumes no responsibility or other liability for your safety.

For these reasons, we strongly recommend that you obtain comprehensive travel insurance that covers trip interruption and cancellation, as well as adequate medical insurance that covers personal injury, medical expenses, repatriation costs, and evacuation expenses incurred during your tour. Note that insurance policies vary and may not provide coverage for the optional activities in which you might be engaged during your trip. For instance, some policies do not cover hot air ballooning while others might. Please consider the nature of your trip and the activities you will be engaged in and obtain appropriate insurance.


Rothschild Safaris cannot be held responsible for vehicle and/or equipment breakdowns or for injuries to person or property arising out of vehicle/equipment accidents which occur while on your tour. 

Developing countries are not subject to the same ‘health and safety’ regulations that exist in the U.S. Many accommodations, activities, and rules are more relaxed than they would be in the U.S. Swimming pools are unlikely to be fenced or have depth markings. Steps around camps often do not have handrails and may be uneven. Camp pathways are sometimes uneven or slippery and may be unlit at night. You may come in contact with animals and insects. Some vehicles will not have seatbelts; particularly those in safari camps. Drivers may drive faster than you are comfortable with so please ask them to slow down. Life jackets may not be within reach so please ask for them. It is your responsibility to help manage your safety throughout your tour. If you ever feel uncomfortable, please speak up.


Please be aware that our tours may take you into close contact with wild animals. Rothschild Safaris cannot be held responsible for any injury or incident on the Tour. Please note that the majority of the safari camps are not fenced and wildlife moves freely in and around the camps. Always follow the safety instructions from the camp staff.


The tour price does not include travel insurance. Rothschild Safaris believes that your tour is a significant investment which you should protect and we strongly suggest that you obtain comprehensive travel insurance including medical coverage through a provider of your choice, covering medical, accident/life, evacuation, and repatriation, which might arise as a result of loss, damage, injury occurring to you, as well as any dependents and traveling companions for the duration of your tour. We also strongly recommend that you extend your coverage to include trip interruption and cancellation, curtailment, loss of belongings and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience. To protect your investment given that we cannot provide refunds in most instances, we also strongly urge you to consider a “cancel for any reason” travel insurance policy, which requires timely action as it must be purchased soon after your initial deposit. We will take no responsibility for any costs for loss of personal luggage, money, and goods, medical expenses, theft, damage or cancellation or curtailment of the adventure. You will be charged directly by the relevant service provider for any emergency services you may require.


Neither Rothschild Safaris nor its independent suppliers assume any responsibility for the attitudes, personalities, or behavior of other tour members. Normally, friendly and positive people take safaris. Those tour members who have serious health problems, mental or physical, are asked not to sign up for this tour.

If in our reasonable opinion or in the opinion of any person in authority associated with your tour feels that your behavior is causing harm, danger, or damage to property or person(s), embarrassment, harassment, or is persistently affecting the enjoyment of others, we reserve the right to terminate your vacation. Should this happen, no refund or compensation will be paid. Should you decide not to participate in certain parts of the tour or use certain goods included in the tour, no refunds will be made for those unused parts of the tour.


If you have any cause for complaint while on your Tour, you must immediately bring it to the attention of your tour guide or to Rothschild Safaris, who will attempt to resolve the situation. Failure to do so while you are on the tour will extinguish or reduce your ability to claim compensation from Rothschild Safaris. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you are not satisfied after using this notice procedure, you must submit your complaint in writing to Rothschild Safaris within 30 days of the Tour’s end date.


It is your responsibility to be ready to embark on the tour as specified in the itinerary. We are not responsible for any losses due to cancelled or missed flights.


You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other tour members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, the local guide/supplier has the right in their sole discretion to remove anyone who they determine to detract from others’ enjoyment of the tour.


You agree that Rothschild Safaris may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform us or your tour leader in writing before the start of the tour.


All information given in any brochure or otherwise advertised, (including electronic advertisements on the Internet) is, to the best of Rothschild Safaris’ knowledge, correct, but Rothschild Safaris cannot guarantee that all such information is accurate. Further, Rothschild Safaris reserves the right to change such information before any Tour. The photographs reproduced and information provided depict typical scenes experienced and details on each destination. However, the depicted or described subject matter may not necessarily be seen or experienced while visiting that destination as conditions and itineraries may change, be adjusted, etc. as explained these terms.


If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable, and which achieves, to the extent possible, the original objectives and intent of the original provision.


This agreement shall inure to the benefit of and be binding upon Rothschild Safaris and you and your respective heirs, legal and personal representatives, successors and assigns.


We may on occasion amend these Terms and reserve the right to update or alter these Terms at any time. Any amendment will take effect seven days after being posted to our website, immediately upon notice to you in writing by email or mail, or upon your continued use of our services or participation on one of our Tours will constitute your acceptance of the changes, whichever occurs first. An up-to-date hard copy of these Terms will be sent to you upon your written request. You are deemed to have accepted any amendments to these Terms on the date that is seven days after their posting on our website or immediately upon notice to you in writing by email or mail. We recommend that you refer to these Terms prior to travel to familiarize yourself with the most up-to-date version available.


In addition, we shall not be liable for (a) expenses such as additional hotel nights and meals not specified in the individual trip itineraries, but which may be required to get to or from a trip start or end; (b) expenses due to the delay of a trip for any reason (e.g., bad weather, trail conditions, landslides, flooding, sickness, etc.); and (c) expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip, or in shipping purchases or other goods home from abroad.


I agree that any dispute concerning, relating to, or referencing this agreement, or any other literature concerning my tour or the tour itself shall be resolved exclusively by binding arbitration according to the then existing commercial rules of the American Arbitration Association in Denver, Colorado. Such proceedings shall be governed by substantive Colorado law. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or part of this contract is void or voidable.


This agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.


I understand that acceptance of the Reservation Confirmation covering this Tour and payment thereof is an acceptance by me of these Terms and Conditions and for other tour conditions applicable to the tour. I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND AND ACCEPT THOSE CONDITIONS.

I certify that I have not recently been treated for, nor am I aware of, any physical or other condition or disability that would create a hazard to me or other members on this tour.

I understand that Rothschild Safaris, Inc. reserves the right to adjust U.S. Dollar prices, without notice, to reflect fluctuations in the Foreign Exchange Markets. Rothschild Safaris, Inc. has no control over taxes or special assessments which may be imposed by non-US Governments.

I intend to purchase travel insurance to cover my investment. Should I not purchase said insurance, I understand that I am assuming any financial loss associated with this Tour.

I have read this entire agreement, and I am signing it freely. I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me. I confirm that I have had an opportunity to have all of my questions about this agreement answered by Rothschild Safaris. My signature applies to all pages of this agreement.
